Midwest Solid Surface LLC dba Millennium Surfaces (“Millennium Surfaces”) warrants the workmanship of countertop installation services performed by Millennium Surfaces for a period of one (1) year from the original installation date, subject to the terms, limitations, and exclusions below.
This warranty covers installation workmanship only. It is not a warranty against normal wear and tear, maintenance items, material characteristics, product failures, or conditions unrelated to the original installation workmanship.
Warranty Coverage
If, during the one-year warranty period, Millennium Surfaces determines that a covered condition resulted from defective installation workmanship, Millennium Surfaces will, at its option, repair, resecure, adjust, or reinstall the affected component as reasonably necessary to correct the installation workmanship.
Examples of installation workmanship that may be covered include:
- Failure of a sink attachment or mechanical support system installed by Millennium Surfaces.
- Failure of countertop attachment or support installed by Millennium Surfaces.
- Installation-related seam issues determined to be the result of improper workmanship.
- Other conditions determined by Millennium Surfaces to have resulted directly from defective installation workmanship.
Coverage ends one (1) year after the original installation date. Service, adjustment, or repair performed during the warranty period does not restart or extend the original one-year warranty period.
Normal Wear, Maintenance & Caulking
This warranty does not cover normal wear and tear or routine maintenance of the countertop or surrounding components.
The homeowner is responsible for inspecting and maintaining caulk and silicone joints and reapplying them as necessary.
This exclusion includes, but is not limited to, silicone or caulk:
- Between countertops and walls.
- Along backsplashes and side splashes.
- Around sinks and sink rims.
- At countertop-to-cabinet or countertop-to-trim transitions.
- Around plumbing fixtures or other penetrations.
- At other joints where flexible sealant is used.
Separation, cracking, shrinking, discoloration, deterioration, or loss of adhesion of caulk or silicone is considered normal maintenance and is not, by itself, evidence of defective installation workmanship.
Recaulking or reapplying silicone after installation is the responsibility of the homeowner and is not included as warranty service.
Sink Installations
When Millennium Surfaces installs or attaches an undermount sink, the one-year workmanship warranty covers the original sink attachment and support workmanship performed by Millennium Surfaces.
If a sink attachment or support system installed by Millennium Surfaces fails within the one-year warranty period and Millennium Surfaces determines that the failure resulted from defective installation workmanship, Millennium Surfaces will reattach and properly secure the sink at no charge.
Routine replacement or maintenance of silicone or caulk around the sink is not covered.
Millennium Surfaces does not perform or warrant plumbing work unless specifically stated otherwise in writing. Plumbing connections, disconnections, drain assemblies, faucets, garbage disposals, water supply lines, and other plumbing components are outside the scope of this installation workmanship warranty.
Limitation of Warranty Remedy
Millennium Surfaces’ obligation under this warranty is limited to inspecting the affected installation and correcting covered defective installation workmanship.
To the fullest extent permitted by applicable law, Millennium Surfaces does not reimburse or assume responsibility under this warranty for costs or damages beyond the repair or correction of the covered installation workmanship itself.
This includes, without limitation:
- Plumbing disconnection, reconnection, repair, or replacement.
- Electrical work.
- Appliance removal, repair, replacement, or reconnection.
- Cabinet repair or replacement.
- Flooring, subflooring, drywall, trim, paint, or other building finishes.
- Water extraction, drying, remediation, mold testing, or mold remediation.
- Damage to personal property or contents.
- Hotel, lodging, meals, lost wages, loss of use, or other incidental expenses.
- Work performed by plumbers, electricians, contractors, remediation companies, or other third parties.
- Other incidental, indirect, special, or consequential costs or damages, to the extent such limitations are permitted by applicable law.
The existence of a covered installation workmanship issue does not, by itself, make Millennium Surfaces responsible under this warranty for third-party services or other resulting expenses.
Material & Manufacturer Warranties
This warranty covers Millennium Surfaces’ installation workmanship only.
Countertop materials, sinks, fixtures, appliances, and other manufactured products may be covered by separate warranties provided by their respective manufacturers. Those warranties are separate from this installation workmanship warranty.
Natural or expected characteristics of countertop materials—including variations in color, pattern, veining, texture, fissures, pits, surface characteristics, and other characteristics inherent to the selected material—are not defects in installation workmanship.
Additional Exclusions
This warranty does not cover:
- Normal wear and tear.
- Routine maintenance.
- Caulk, silicone, adhesives, or flexible sealants requiring normal maintenance or replacement.
- Scratches, chips, stains, etching, burns, impact damage, or other damage occurring after installation.
- Damage resulting from standing, sitting, climbing, or placing excessive weight on the countertop.
- Building, cabinet, wall, floor, or foundation movement or settlement.
- Cabinets or supports that become loose, shift, settle, or fail after installation.
- Improper use, abuse, neglect, impact, or alteration.
- Work performed, repaired, or modified by another contractor, homeowner, plumber, appliance installer, or other third party.
- Plumbing leaks or failures.
- Appliance or fixture failures.
- Water intrusion from sources unrelated to Millennium Surfaces’ installation workmanship.
- Improper maintenance or failure to follow applicable care instructions.
- Damage caused by fire, flood, freezing, severe weather, structural movement, or other circumstances outside Millennium Surfaces’ control.
- Conditions resulting from components, materials, structures, or systems not furnished or installed by Millennium Surfaces.
Customer Responsibilities
The customer must notify Millennium Surfaces promptly after discovering a suspected installation workmanship issue and take reasonable steps to prevent additional damage.
Millennium Surfaces must be provided a reasonable opportunity to inspect the reported condition and, when covered, perform the corrective work.
Except in an emergency where immediate action is reasonably necessary to protect persons or property, the customer should contact Millennium Surfaces before authorizing third-party repairs related to an alleged installation workmanship issue.
Third-party work or expenses are not automatically authorized or reimbursable by Millennium Surfaces.
Warranty Claims
Warranty claims must be reported to Millennium Surfaces within one (1) year of the original installation date.
The customer should provide the customer name, installation address, installation date or job number, a description of the condition, and photographs when requested.
Millennium Surfaces reserves the right to inspect the installation and determine whether the reported condition is covered by this workmanship warranty.
Warranty Term
This installation workmanship warranty begins on the date of the original countertop installation and expires one (1) year thereafter.
After the one-year warranty period, service calls, adjustments, repairs, sink reattachments, caulking, silicone replacement, seam service, or other work may be available at Millennium Surfaces’ then-current service rates.
Exclusive Installation Warranty
This document describes the installation workmanship warranty provided by Millennium Surfaces and is separate from any applicable manufacturer material or product warranty.
No employee, installer, dealer, builder, contractor, or other person is authorized to expand or modify this warranty unless the modification is made in writing and authorized by Millennium Surfaces.
Any limitations or exclusions contained in this warranty apply only to the extent permitted by applicable law.
